WebMy understanding is that the date you communicate to EI and the date you communicate to your employer are independent from each other. You can't switch from 12 month to 18 month leave for EI because the payments differ and you're locked into one payment or the other, but you are legally entitled to take up to 18 months leave from your employer. Reason being if I decide not to take the whole 18 months I wouldn’t be out any of the benefit (if you pick 18 months and go back early you’ve been paid less).
